The Student Disability Center (SDC) is committed to respecting and protecting the privacy of student information. Student information held by the SDC is considered part of a student’s educationa record protected by the Family Educational Rights and Privacy Act (FERPA). Examples of information in a student’s education record at SDC includes, but is not limited to, disability documentation, accommodation letters, case notes, and correspondence. While the SDC may hold medical documentation in a student’s record, this documentation is not protected by HIPAA because the SDC is not a medical provider.

Under FERPA, student education records cannot be shared with any entity outside the university without the student’s consent unless an exception under FERPA applies. Student information will not be released to parties outside CSU, including, but not limited to, parents/family members, medical providers, and other colleges or universities, without the student’s consent unless required or permitted under FERPA For example, CSU may be required to provide information in response to a valid court order or subpoena, or may release information in a health or safety emergency.  Additionally, under the CSU Title IX Policy, SDC staff are considered responsible employees and are obligated to report any information related to sexual assault or interpersonal violence to the CSU Office of title IX Programs and Gender Equity.

SDC staff are allowed to share information about a student on a need-to-know basis with relevant faculty and/or staff within the institution without prior consent from the student. The SDC uses great discretion with what information they share and when possible seek consent from the student on what information is shared. SDC keeps the information shared to a minimum and only what is relevant to the situation.

Student information is securely stored in the Student Disability Center, network drives, and/or data management system. Student records are retained in accordance with the CSU records retention policy.

Neither a student’s disability nor the use of accommodations is noted on a student’s transcripts.
